Allied Peoples Movement (APM) and its governorship candidate, Adekunle Akinlade in the last election held in Ogun State, have formally appealed to the judgement of the state election petitions tribunal at the court of appeal in Ibadan, Oyo State.
The notice of appeal which was sent to the court on Thursday 3rd October 2019, the APM described the judgement of the tribunal as being against the weight of the evidence that was presented before it during the trial of APM and Akinlade’s petition in the state.
Akinlade and APM had earlier challenged the victory of the All Progressives Congress (APC) and its governorship candidate, Mr Dapo Abiodun at the March 9th 2019 governorship election. The tribunal was led by Justice Yusuf Halilu, its judgement which was delivered on September 14th 2019, finally dismissed the petition filed by Akinlade and APM for being incompetent and lacking in merit. Akinlade in the notice of appeal had listed claims that the judgement of the tribunal was not based on the issues submitted by the petitioners, especially in relation to the respondent’s academic qualifications.
The trial judges of the lower tribunal made a mistake in law by contradicting and misdirecting themselves when having found page 29 and 30 of the ruling in respect of the 2nd respondent’s preliminary objection.
“The trial judges of the lower tribunal also made a mistake in law by denying the appellants the right to a fair hearing. They completely diminished from same on page 32 and 33 of the ruling, in consequence of which the appellants were unable to take benefit of the favourable findings.”
